Section 1
By accessing HEARD, clicking "I agree," completing registration, uploading content, or using any service feature, you agree to be bound by these Terms, our Privacy Policy, and any additional guidelines posted on the platform. If you are using HEARD on behalf of a business, label, management company, or agency, you represent that you have authority to bind that entity to these Terms.
Your continued use of HEARD after any update to these Terms constitutes acceptance of the updated Terms.
Section 2
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By registering, you confirm that you meet this requirement.
HEARD is not available in jurisdictions where it is prohibited by law. We reserve the right to restrict access by region at any time.
Section 3
You agree to provide accurate, complete, and current information when creating your account, including your real name, a valid email address, and correct billing information where required. Providing false identity information — including creating a fake artist profile, claiming to be an artist you are not, or misrepresenting your relationship to an artist — is a violation of these Terms and may result in immediate suspension.
Each account represents one authorized user. You may not register multiple accounts to circumvent plan limits, access free credits more than once, or conduct any form of platform abuse.
Section 4
You are responsible for maintaining the security of your login credentials. Do not share your password, access token, or account with any other person. If you suspect your account has been compromised, contact us immediately.
HEARD may monitor account activity for unusual patterns, including logins from multiple devices, rapid geographic changes, and identity inconsistencies, as part of platform security. You consent to this monitoring by using the platform.
Section 5
HEARD offers free and paid subscription plans. Paid plan details, including pricing and included features, are listed on the Pricing page. Pricing is subject to change with reasonable notice.
Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation stops future charges but does not entitle you to a refund for the current period.
Annual plans are billed upfront for the full year. Monthly plans are billed at the start of each monthly period.
Section 6
HEARD uses a credit system to manage access to reviews, interviews, and analysis. Credits are reserved when a process begins and consumed when a valid completed output is delivered. Eligible technical failures caused by the platform may restore credits automatically. Credits consumed for completed valid outputs are not refundable.
User-caused issues — including incorrect file uploads, misleading metadata, unauthorized content, incomplete submissions, or duplicate account abuse — do not qualify for automatic credit restoration.
Credits are non-transferable and have no cash value. They expire per the terms of your plan or promotional agreement.
Section 7
Free trials and promotional periods provide temporary access to paid features. Trial terms, including duration and included access, are disclosed at the time of activation. When a trial or promotional period ends, access reverts to your base plan or the free tier unless you subscribe to a paid plan.
Invite codes and promotional codes are single-use per account unless explicitly marked multi-use. Reselling, transferring, or misusing invite codes — including using them to gain unauthorized group access — violates these Terms. Suspected invite code abuse may result in code suspension and account review.
Free accounts include 2 complimentary analysis credits and 1 complimentary Mini Interview credit. These are lifetime allocations and do not reset monthly. Creating additional accounts to obtain more free credits is prohibited and constitutes platform abuse.
Section 8
Each HEARD account is associated with one primary artist identity. Your plan determines how many artist profiles or artist workspaces you may operate:
Generating reviews, interviews, or public content for an artist not covered by your plan is a violation of these Terms.
Section 9
Before publishing an artist profile, public review, or public interview, you must confirm that you own or are authorized to represent the artist associated with the content. HEARD may require verification of this authorization through connected streaming profiles, uploaded documentation, or admin review.
Ownership statuses in HEARD include: Unverified, Self-Claimed, Link-Verified, Admin-Approved, Disputed, and Suspended. Unverified profiles operate in private draft mode. Public publishing requires at minimum a Self-Claimed confirmation, and may require Link-Verified or Admin-Approved status for certain features.
Section 10
You may not share your HEARD login credentials, access tokens, or session with any other person or entity. You may not allow other artists, managers, or teams to use your account to access paid features not covered by your plan. You may not sell, sublicense, or transfer your account.
Prohibited activities include:
Section 11
You retain ownership of the music, lyrics, photos, written materials, and other content you upload to HEARD. By uploading content, you represent and warrant that you own it or have the necessary rights, permissions, and licenses to use it on the platform and to authorize HEARD to process it as described in these Terms.
You are solely responsible for ensuring that your uploaded content does not infringe on any third-party copyrights, trademarks, personality rights, privacy rights, or other legal rights.
Section 12
By uploading content to HEARD, you grant HEARD a limited, non-exclusive, royalty-free license to: store, process, analyze, and use your uploaded content to provide the services you request; generate AI-assisted editorial content from your materials; display your public reviews, interviews, and artist profile pages (where approved by you); and operate, maintain, and improve the HEARD platform.
This license is limited to the purposes described above. HEARD does not claim ownership of your music, images, or written materials. This license terminates when you delete content or close your account, subject to standard backup and legal retention periods.
Section 13
You must not upload to HEARD: music you do not own or have explicit permission to analyze; unreleased recordings without authorization from all rights holders; copyrighted photos or press materials without written permission; fake artist profiles, impersonation content, or misleading identity information; private information about others without their consent; defamatory claims or content designed to harm a person's reputation without factual basis; or content that is illegal under applicable law.
For photo uploads specifically, you confirm: you own or have permission to use the photos; you have permission from any identifiable people who appear in the photos; you authorize HEARD to use the photos solely for your HEARD interview, profile, and editorial outputs; and you understand that photos marked Private will not be published unless explicitly approved by you.
Section 14
No content on HEARD is published publicly without your explicit approval. Private drafts, private reviews, and private interviews remain private unless you initiate publication. You may unpublish a public page at any time through your account settings.
Before publishing any public review, interview, or artist profile, you will be presented with a confirmation screen asking you to confirm ownership and authorization. This step is required and cannot be bypassed.
HEARD may pause or remove public content if a credible dispute, copyright claim, impersonation complaint, or Terms violation is reported. You will be notified and given the opportunity to respond.
Section 15
HEARD uses artificial intelligence to generate editorial analysis, reviews, and interview output. You acknowledge and agree that:
Section 16
HEARD does not guarantee and expressly disclaims any promise of: streams, plays, or listener counts; press coverage, playlist placement, or editorial features; label interest, A&R attention, or industry introductions; search engine ranking or first-page placement; revenue, royalties, or commercial success; or career advancement of any kind.
Section 17
If you believe content on HEARD infringes your copyright, constitutes impersonation, or violates your privacy, you may file a dispute via our dispute form (available at /disputes). We will review all credible complaints promptly.
When a credible high-risk dispute is received, HEARD may immediately hide the relevant public page while the dispute is under review. Evidence will be preserved internally. The account owner will be notified and given an opportunity to respond. Admin review will result in one of the following outcomes: content restored, content removed, or account actioned.
Knowingly filing false takedown or dispute claims violates these Terms and may result in account suspension.
Section 18
Creating an artist profile, review, or interview for an artist you do not own or represent — without proper authorization — is impersonation and is strictly prohibited. This includes claiming to be a well-known artist, creating content under another artist's name without their permission, and misleading HEARD or its users about your identity or authorization.
HEARD may suspend accounts and remove content associated with confirmed impersonation without notice.
Section 19
HEARD collects account data, uploaded audio and images, artist links, interview answers, review outputs, billing status information, device and session logs, and admin audit logs. Full details are available in our Privacy Policy.
Private drafts are not visible to the public. You control whether completed reviews and interviews are published. Deleted or unpublished content may remain in encrypted backups for a limited period before permanent deletion. All admin access to your data is logged.
Section 20
If you believe a charge is incorrect, contact us before initiating a chargeback. Chargebacks filed without first contacting HEARD support constitute a breach of these Terms and will trigger an account review. Accounts with open chargebacks may be suspended pending resolution. Confirmed fraudulent chargebacks may result in permanent account termination and referral to collection.
Section 21
Completed, valid reviews and interviews are non-refundable. Credits consumed for successful outputs are not restored. Accounts suspended for Terms violations are not entitled to refunds of paid subscription periods. Technical failures caused by the HEARD platform may qualify for credit restoration, reviewed on a case-by-case basis. HEARD may, at its sole discretion, issue courtesy credits for platform errors or exceptional circumstances.
Section 22
HEARD reserves the right to warn, freeze, downgrade, suspend, or permanently ban any account that violates these Terms, engages in platform abuse, poses a fraud or legal risk, or is subject to a credible unresolved dispute.
Graduated enforcement steps include: warning notification; temporary publishing freeze; verification required hold; credit revocation; invite code suspension; downgrade to free tier; account suspension; and permanent ban. We reserve the right to skip steps based on severity.
You may delete your account at any time. Account deletion does not guarantee immediate removal of all data, as backups and legal records may be retained per applicable law.
Section 23
HEARD may offer beta or experimental features. These features are provided as-is, without warranty, and may be modified, paused, or discontinued at any time. Use of beta features does not create any entitlement to their continued availability.
Features described as "coming soon," "roadmap," or "planned" are subject to change and are not contractual commitments.
Section 24
HEARD may link to or integrate with third-party services, including streaming platforms, social media, and payment processors. HEARD is not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is subject to their own terms.
Section 25
To the maximum extent permitted by applicable law, HEARD and its founders, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, loss of data, reputational damage, or lost business opportunities, arising from your use of the platform.
HEARD's total liability for any claim arising from your use of the platform is limited to the amount you paid to HEARD in the 12 months preceding the claim.
Section 26
You agree to indemnify, defend, and hold harmless HEARD, its founders, employees, contractors, and affiliates from any claim, damage, loss, liability, or expense — including reasonable legal fees — arising from: your use of the platform; your uploaded content; your violation of these Terms; your infringement of any third-party right; or your misrepresentation of identity or ownership.
Section 27
HEARD provides editorial and analytical assistance. Nothing on the platform constitutes legal advice, financial advice, music industry professional representation, medical advice, or any other form of licensed professional service. Consult a qualified professional for legal, financial, or industry-specific guidance.
Section 28
We may update these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform. Continued use of HEARD after the updated Terms take effect constitutes your acceptance. The effective date at the top of this page reflects the most recent version.
Section 29
For questions about these Terms, disputes, copyright claims, or account issues, use the dispute and contact form on the platform. We aim to respond to all inquiries within 3–5 business days.
